Terms of Service

Welcome to Crafted Pour. These Terms of Service (“Terms”) govern your access to and use of the Crafted Pour website, mobile applications, embeddable recipe widgets, Virtual Bartender AI, content management system (CMS), and associated B2B SaaS tools (collectively, the “Platform”), operated by CraftedPour, Inc., a Delaware C-Corporation (“Crafted Pour,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility & Age Restriction

You must be of legal drinking age in your jurisdiction (21 years of age in the United States) to access and use the Platform. By using the Platform, you represent and warrant that you meet this age requirement. Crafted Pour reserves the right to terminate accounts, restrict access, or remove content if we believe this requirement is not met. We promote responsible drinking and do not endorse excessive or underage consumption. As our Platform features alcohol-related content, you are solely responsible for ensuring that your access to and use of the Platform complies with all applicable local laws and regulations regarding alcohol marketing and consumption in your jurisdiction. 2. Platform Services

Crafted Pour provides a multi-sided content-to-commerce ecosystem:

• For Consumers: A curated directory of cocktail recipes, spirit education content, AI-driven recommendations via our Virtual Bartender, and facilitated e-commerce purchasing through third-party retailers.
• For Creators: Portfolio and publishing tools to submit recipes, build an audience, receive tips from fans, and earn affiliate commissions on product sales driven by their content.
• For Brands: B2B SaaS tools including embeddable recipe widgets for brand websites, a content management system (CMS) with editorial controls, analytics dashboards, e-commerce attribution reporting, and the Tastemaker managed content program.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. Crafted Pour is not liable for losses arising from unauthorized access to your account. We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.

4. Creator Content Licensing & Rights

You retain ownership of the content you submit, including recipes, tasting notes, photos, and videos (“User Content”). By submitting User Content to Crafted Pour, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Platform and our marketing.

Syndication: This license explicitly includes the right for Crafted Pour to syndicate your User Content through our recipe widgets onto third-party brand partner websites and retail materials. Your creator attribution will be maintained in all syndicated contexts. Brands may feature your content in their marketing provided proper attribution to you is given.

AI Training: We may use publicly available User Content to improve our Virtual Bartender AI's recommendation quality. This use is limited to improving the relevance and accuracy of cocktail recommendations and does not involve sharing your content with third-party AI model providers.

Content Removal: You may request removal of your User Content by contacting us at support@craftedpour.com. Removal may take up to 30 days and may not apply to content that has been previously syndicated to third-party sites (we will make reasonable efforts to remove syndicated content upon request).

5. Creator Compensation

Creators may earn compensation through multiple channels: affiliate commissions on product sales driven by their recipes, tips from consumers, and fixed payments through the Tastemaker managed content program. Commission rates, payment schedules, and program terms are communicated separately and may change with notice. Crafted Pour is not responsible for tax reporting or withholding on creator earnings; creators are responsible for their own tax obligations.

6. Brand Subscriptions & Payments

Brands may subscribe to SaaS features at various tiers. Subscription payments are processed securely by Stripe. By subscribing, you agree to the recurring billing terms presented at checkout. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled on a case-by-case basis. Crafted Pour, Inc. is the billing entity. While we target high availability for our recipe widgets and APIs, the Platform is provided “as is”; we do not offer Service Level Agreements (SLAs) with financial penalties unless explicitly defined in an Enterprise contract.

7. E-Commerce & Affiliate Disclosure

Third-Party Fulfillment: Crafted Pour does not hold a liquor license and does not directly sell, fulfill, or ship alcohol. All purchase transactions initiated through our Platform (including via shop.craftedpour.com, “Buy” buttons, shopping lists, or ingredient links) are fulfilled by third-party licensed retailers or fulfillment networks, including but not limited to Bottle Nexus, Drizly, and Amazon. Crafted Pour is not liable for product quality, shipping delays, damaged goods, incorrect orders, or any other fulfillment issues arising from these third parties.

FTC Disclosure: Crafted Pour participates in affiliate marketing programs. When you purchase items through links on our Platform, Crafted Pour and/or the recipe Creator may earn an affiliate commission. This does not affect the price you pay. Affiliate relationships do not influence the editorial integrity of our recipe content.

8. Virtual Bartender AI Terms

The Virtual Bartender is an AI-powered conversational assistant that provides cocktail recommendations based on your stated preferences and our recipe database. The Virtual Bartender:

• Is grounded in Crafted Pour's proprietary content database and will only recommend recipes and products within our catalog.
• When deployed on a brand partner's website, will only recommend that brand's products and approved recipes (brand-safe grounding).
• May occasionally produce inaccurate or incomplete information. Recommendations are suggestions, not professional advice.
• Does not provide medical, health, or dietary advice. If you have allergies or dietary restrictions, verify all ingredients independently.
• Conversations may be logged for quality assurance and safety monitoring.

9. Acceptable Use & Brand Safety

You agree not to use the Platform to post illegal, hateful, explicit, threatening, or otherwise harmful content; submit content that infringes third-party intellectual property rights; attempt to reverse engineer, scrape, or interfere with the Platform's operation; impersonate another person or entity; or use the Platform for any purpose that violates applicable law.

Content Moderation: All user-submitted recipes and content are reviewed by our editorial team before publication. Crafted Pour reserves the right to reject, edit, or remove User Content at our sole discretion.

Brand Safety: When recipes are syndicated to a brand partner's website via our widgets, Crafted Pour utilizes automated product substitution and filtering to ensure competitor products are not displayed, protecting brand equity and contractual obligations.

10. Intellectual Property

Excluding User Content, all content, technology, and materials on the Platform — including the Virtual Bartender AI, widget source code, CMS software, site design, branding, logos, and proprietary databases — are the exclusive intellectual property of CraftedPour, Inc. You may not copy, modify, distribute, reverse engineer, decompile, scrape, or create derivative works of our proprietary technology without our written consent.

11. Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CRAFTED POUR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. IN NO EVENT SHALL CRAFTEDPOUR, INC. OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS SHALL AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER UNDER APPLICABLE LOCAL LAW, INCLUDING IN THE UK AND EU.

12. Indemnification

You agree to indemnify and hold harmless CraftedPour, Inc. and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your User Content, your violation of these Terms, or your violation of any third-party rights.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Platform shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may initiate binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in San Diego County, California. The arbitrator's decision shall be final and binding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in San Diego County, California.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms with a new effective date. For significant changes, we may also provide notice via email or in-app notification. Your continued use of the Platform after the effective date constitutes your acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
